이 연구는 인권과 정치체제의 기본 속성, 그리고 지역협력 사이의 상관관계에 초점을 맞추어 동남아 국가들의 인권 현황과 인권정책을 고찰하고, 아세안(ASEAN)을 중심으로 지역 차원의 인권협력 수준을 분석하는데 주요 목적이 있다. 이를 위해 이 연구는 동남아 지역에서 민주화가 이루어진 필리핀, 태국, 인도네시아를 중심으로 이들 국가들의 인권 현황과 아세안 내부에서의 인권협력 상황을 고찰하였다. 연구 결과, 이들 국가들의 인권 현황과 인권정책, 그리고 지역협력 수준은 다른 지역 및 국가들과 비교하여 상대적으로 열악한 수준을 크게 벗어나지 못하고 있다. 이것은 동남아 국가들이 국내적으로 처한 정치구조나 경제 환경 때문이기도 하지만, 민주화된 국가들조차 인권 문제를 주권과 민족주의 차원으로 고려하는 각국 정부 및 정치지도자들의 부정적인 인식과 태도 때문이기도 하다. 동남아 국가들은 과거 서구 열강에 의한 식민지배의 유산으로 인해 인권 문제에 대한 외부적 압력을 국가주권 문제로 받아들이고 있으며, 국가․지역 단위에서 인권운동을 전개하는 시민단체들 역시 정치적 환경과 재정적 한계 때문에 원활한 연대활동을 추진하지 못하고 있다. 결과적으로 동남아 지역에서 인권 문제가 조속히 개선되기 위해서는 각 국가들의 민주화와 더불어 인권 문제에 대한 역내 국가 간, 정부와 시민단체 사이의 대화와 지역협력이 강화되어야 할 것이며, 설혹 국가 간 주권과 문화적 특수성을 인정한다고 하더라도 역내 국가들 사이의 합의를 통한 인권의 보편적 개념이 확립되어야 할 것이다.
영어 초록
The purpose of this study is to explore the present status of human rights and human rights policies in Southeast Asian countries, and to analyze the regional cooperation for human rights improvement with focus on the mutual relationship between human rights, political regime, and regional cooperation in the region. For this research purpose, this study is to analyze the situational changes of human rights in the Philippines, Thailand, and Indonesia, who were democratized in Southeast Asia, and their regional cooperation activities in the ASEAN (Association of Southeast Asian Nations). As a research result, the level of human rights situation, policies, and regional cooperation in the region was inferior to other regions and countries. The reasons of this result were not only caused by domestic political structures and difference of economic situation in Southeast Asian countries, but also due to their negative cognitions and attitudes toward human rights, which were regarded as a obstacle to their state sovereignty and economic development. Because of the old legacy of long colonial reign by the Western countries, many Southeast Asian countries responded sensitively to outer's interference for human rights. The ASEAN, as an regional consultant body, also could not explored ways toward epochal alternatives for human rights improvement in the region. In the level of state and region, civil society groups, which propelled human rights movements, could not tried to develop the regional solidarity activities because of domestic political environment and financial limitations. In conclusion, for improving the human rights more fast in Southeast Asia, it must be continued to endeavor for regional cooperation between interstates, and each government and civil society group, and to grope for adequate policies for human rights. And, also, although we concede interstate sovereignty and cultural speciality, it must be settled the universal concept of human rights by the consultation among Southeast Asian countries in the ASEAN.
