지난 5월 30일 발의된 「발달장애인 지원 및 권리보장에 관한 법률안」의 실효성을 높이기 위해 본 연구는 발달장애에 대한 용어가 장애인관련 단체 등 현장과 교육분야, 복지분야 등 각 분야에 따른 차이와 시사점을 중심으로 논의를 진행하면서 동시에 「발달장애인지원법」등의 타법과의 관계에 초점을 두고 검토하는 것을 목적으로 한다.연구결과, 「발달장애인 지원 및 권리보장에 관한 법률안」과 「장애인 등에 대한 특수교육법」의 특수교육 대상자와「장애인복지법」상의 장애개념 관련 용어에서 차이를 보이고 있고, 연령별 차이를 보이고 있어 향후 혼란이 예상된다. 따라서 학제간의 공동연구를 통해 분야별법과의 상호연계성 확보를 모색할 필요가 있으며, 법률간 조정과 기관과 연계의 근거를 제시하는 법률이 마련되어야 할 필요가 있다. 이는 일본의 「장애인기본법」처럼 장애인복지법을 중심으로 각 분야별로 법률이 구성되어야 할 필요가 있으며, 이를 위해 학제간 공동연구의 필요성이 더욱 요구된다.
또한, 법률적, 의료적 현장 등에서 사용되고 있는 국내외 발달장애의 개념을 비교분석한 결과, 발달장애는 뇌기능 결함과 관련된 장애로, 중증의 만성적인 장애가 있으며, 유아기 아동도 그 대상에 포함되어야 점들을 고려할 필요가 있다.
영어 초록
The purpose of this study was to discuss differences in terms on developmental disabilities and their suggestions in disabilities-related groups and each field such as education and welfare to enhance the effectiveness of 「Developmental Disabilities Assistance and Bill of Rights Act」initiated on May 30. Also, this study attempts to examine the relationship with other laws such as 「Developmental Disabilities Assistance Act」.As a result, there was difference in special education subjects under 「Developmental Disabilities Assistance and Bill of Rights Act」and 『Act on Special Education for the Disabled Persons, etc.』and disabilities-related terms under 『Welfare of Disabled Persons Act』. Age difference was also found, which may give rise to confusion. Accordingly, it is necessary to explore the methods to secure interconnection with field law through inter-disciplinary study and provide the law which presents the basis of law adjustment and institutional connection. In other words, like 『Basic Law for Persons with Disabilities』in Japan, the law should be constituted by field around the welfare law for persons with disabilities and therefore, inter-disciplinary study is required more greatly.
Domestic and international concepts of developmental disabilities used in the law, medical care, and fields were also compared and analyzed. The findings suggest that developmental disabilities were related to the deficit of brain functions, had severe chronic disabilities, and should include young children in the subject.
