THE TEA BOARD v. Mr. Jean-Luc DUSONG is a case to the Tribunal de Grande Instance of Paris filed by the institution affiliated to the Ministry of Commerce & Industry under Indian law. DUSONG is the holder of the semi-figurative trademark consisting of the name ‘Darjeeling’ and the drawing of a teapot. The mission of THE TEA BOARD is controlling its geographical production zones, including the district of Darjeeling.The issues of the case are what the proper law is, whether ‘Darjeeling’ gets an application of protection as geographical indication before registration, whether THE TEA BOARD is standing tosue, whether using the trademark as publication of books, consulting agency which are not related to tea production also makes an infringement of geographical indication, etc. The court of first instance ruled against the plaintiff, but Paris Court of Appeal accepted the appeal of the plaintiff. Paris Court of Appeal found the infringement of geographical indication as the final outcome, however, it is interesting that the court seems to invoke not the exclusive right of geographical indication, but the general principle of civil law. The court seems to consider following reasons.THE TEA BOARD hadn’t registered the geographical indication when DUSONG registered his trademark. Moreover, categories of DUSONG’s and THE TEA BOARD’s have no relevance. Under Korean current law, registration is necessary requirement for geographical indication, so Korean court shall agree the infringement with similar reasons.
