한국어 초록

언론보도에 대한 피해구제제도로 한국에서 인정되는 것은 사전금지청구권(부작위청구권), 손해배상청구권, 명예회복에 적당한 처분(원상회복청구권), 반론보도청구권 등이다. 본 논문은 반론보도청구권을 제외한 여타의 피해구제제도를 소개하고자 한다. 사전금지청구권에 대해 미국연방대법원은 헌법에 위반된다고 판시한 반면, 일본최고재판소는 합헌이라고 판시했다. 우리의 헌법재판소는 사전검열에 해당하지 않으므로 합헌이라고 판단했다. 그러나 법원에 의한 금지청구권의 인용이 헌법상 금지되는 사전검열에 해당되지 않는지 의문이다. 행정부나 사법부나 국가기관이라는 점에서 큰 차이가 없기 때문이다. 사전금지청구권이 언론의 자유에 대한 중대한 위협이 되는 것은 분명한 사실이다. 그러한 점에서 최근 법원이 방송에 대한 사전금지가처분을 인정하는 사례가 늘고 있는 것은 우려할 만한 대목이다. 반론권과 손해배상청구권이 인정되는 우리의 법제도를 감안할 때 사전금지청구권은 부정되는 것이 타당하다.무책임한 언론에 대한 제재수단으로 징벌적 손해배상의 도입이 필요하다는 주장이 제기되고 있다. 징벌적 손해배상의 도입은 쉽게 결정할 수 있는 문제가 아니다. 금지청구권이나 반론권을 인정하지 않고 징벌적 손해배상을 명하되 실제적 악의론을 통해 손해배상을 엄격하게 긍정하는 미국의 명예훼손법은 우리와 분명 큰 차이가 있다. 그러나 황색저널리즘으로 정의되는 무책임하고 선정적인 언론은 개인의 인격권을 중대하게 위협하는 유해한 존재다. 따라서 징벌적 손해배상을 도입한다면 제한적인 범위 내에서 이루어져야 할 것이다. 즉, 징벌적 손해배상은 보도의 대상이 개인이고 보도의 내용이 사적인 영역에 속해 공적인 관심사가 아닌 경우에 한해 인정하는 것이 옳다고 본다. 보도대상이 공인, 단체, 기관이고 보도내용이 공적인 관심사인 경우에는 징벌적 손해배상이 부정되어야 한다. 공적인 영역에서 언론의 자유가 최대한 보장되어야 하기 때문이다.언론의 자유와 개인의 인격권은 어느 하나 경시되어서는 아니 되는 중요한 헌법적 가치다. 개인의 사적인 영역이고 내밀한 영역일수록 개인의 인격권은 보다 폭넓게 보호되어야 할 것이다. 이에 반해 보도의 대상이 공적인 영역에 속하거나 사회적 관심사에 해당하는 것일 경우에는 언론의 자유는 보다 더 중시되어야 할 가치다. 따라서 개인의 인격권보호가 언론의 자유와의 관계에서 어떠한 가치를 지니느냐에 따라 언론보도에 대한 피해구제제도가 인정되는 범위와 정도가 달라져야 할 것이다.

영어 초록

The advance prohibition claim becoming the threat which is serious is the obvious fact about freedom of expression. From such point recently the court of justice the instance which recognizes an advance prohibition provisional disposition being increased about broadcasting the best season is. When considering our laws degree where the objection circle and the damage right to demand reparation are recognized advance prohibition claim being negated hit. About the press which is irresponsible the introduction of punishment compensation for the loss necessity is assertion is proposed with sanction means. Introduction of punishment compensation for the loss is not the problem will be able to decide easily. Does not recognize a prohibition claim or an objection circle not to be, gives an order a punishment compensation for the loss but actual malice theory leads and compensation for the loss strictly, the slander law of the United States which affirms us and is a clearly big difference. Consequently does the personal volume protection of the individual from relationship with freedom of expression have what kind of value according to the scope and the degree where the damage relief system is recognized must change about press report.
