한국어 초록

조례는 지방자치단체가 자신의 사무를 규율하기 위하여 지방 의회의 의결을 거쳐 자율적으로 제정하는 규범을 말한다. 여기에서 과연 삼척시 의회가 “이사부의 날 제정” 조례를 제정할 수 있는지, 제정할 수 있다 하더라도 어떠한 내용과 효력을 가진 조례까지 가능한 것인지는 여러 각도에서 검토하여야 하지만, 그 출발점은 조례의 법적 성격과 국내법 질서와의 조화에 관한 논의라 하겠다. 기본적으로 조례 위임입법설은 조례제정권을 국가로부터 부여된 권한으로 보는 것이다. 헌법, 법률, 법률의 수권에 의해 명령 및 조례가 제정되는 것으로 조례는 명령과 같이 위임입법의 일종이라는 것이다. 조례 자주입법설은 고유권설의 당연한 결론이기도 하지만 자치권을 국가로부터 전래된 권한으로 이해하는 입장 안에서도 행정권의 일부가 아니라 통치권이 위임된 것으로 본다면 이에 의한 조례제정을 위임입법으로 볼 필요가 없게 된다. 삼척시 의회가 제정하게 될 이사부의 날 조례 제정과 관련 유사 선례로는 일본 ‘죽도의 날’ 제정 현 조례, 마산시 의회의 대마도의 날 조례, 경상북도 독도의 달 조례, 울릉군 의회의 울릉군민의 날에 관한 조례가 있다. 비록 지난 18대 국회에서 폐기되기는 하였지만 독도의 날 제정에 관한 법률안, 독도의 날 제정에 관한 청원 등의 선례도 있다. 마지막으로 울릉군 독도명예주민증 발급 규칙과 같이 상위규범에 따른 규칙 제정의 선례로 살펴보았다. 조례 초안에서 제1조는 조례의 목적과 정의, 적용범위 등의 내용으로 구성하였 다. 제2조는 이사부의 날 지정일에 관련 양력 8월 3일로 의견을 합치하였다. 제3 조에서는 각종 기념 행사와 의식, 지적재산권 및 권리와 의무 등 다양한 법률 관련 문제들을 규정하는 것으로 초안을 규정했다. 비록 지난 제18대 국회에서 의원 입법안 2건이 소관 상임위원회에 회부되어 심의 중 임기만료로 폐기된 적은 있다. 그러나 ‘이사부의 날’ 제정에 관한 삼척시 의회의 조례 제정은 조례의 자치입법 성격상 아무런 문제가 되지 않는다. 또한 유사한 선례를 비교 검토해 볼 때에도 삼척시 지방자치단체 차원의 조례제정은 어떠한 무리를 발생할 가능성도 존재하지 않는다. 무엇보다도 삼척시가 다년간 추진해 온 ‘동해’를 아우르는 이사부의 선양사업의 취지와 역사적으로 이사부에 의한 우 산국(울릉도와 독도) 복속 1,500년이 갖는 역사적 상징성과 시의 적절성을 고려할 때 삼척시 의회 주도의 조례 제정의 의미는 매우 뜻 깊은 일이다. 끝으로 만일 시간적 여건으로 인해 필요한 경유 지방자치단체의 장에 의한 ‘규칙’ 제정으로도 이사부의 날 또는 이사부 축전 등 입법안도 고려될 수 있을 것이다.

영어 초록

Ordinance refers to regulations legislated autonomously by local governments to regulate their own affairs through the resolution of the local council. Though it may need to be reviewed in multiple aspects whether Samcheok City Council is able to legislate the ordinance for “Day of Isabu” or not, and if it is possible, what content and effects this ordinance can have, the starting point is to clarify the legal aspects of the ordinance and coordinate its order with other domestic laws. Basically, the theory of delegated legislationof ordinance is to view the legislation right of ordinance as the delegated authority from the country. This theory argues that the order of legislation is constitution, law, and order& ordinance by the delegation of legal power of law and therefore, ordinance is part of delegated legislation like order. The theory of ordinance as autonomous legislation is a natural conclusion from the autonomous theory. However, even with the view of the autonomy as an authority delegated by the government, if it is not part of administrative power but delegated sovereignty, the legislation of ordinance according to this cannot be viewed as delegated legislation. As for similar precedents to the legislation of ordinance of Day of Isabu that Samcheok City Council will legislate, there are the current ordinance legislatingthe Japan’s ‘Day of Jukdo’, the ordinance of Day of Daemado by Masan City Council, the ordinance of Day of Dokdo by Gyeongsangbuk-do and the ordinance of Day of Ulreung Citizens by Ulreung-gun Council. Though discarded in the 18th National Assembly, there were precedents such as the bill on the legislation of Day of Dokdo, petition on the legislation of Day of Dokdo, etc. Finally, the legislation of rules by the higher norm such as the rule of issuing Dokdo honorary citizenship by Ulreung-gun is reviewed as a precedent. Article 1 in the ordinance draft is composed of purposes &definitions of the ordinance, its application scope, etc. Article 2 includes the consented date for the Day of Isabu as August 3rd. Article 3 regulates various legal issues such as various memorial events, ceremonies, intellectual property, rights & duties, etc. In the 18th national assembly, two bills were forwarded to the applicable standing committee for the review but eventually discarded due to the termination of the term. However, the legislation of ordinance by Samcheok City Council on ‘Day of Isabu’ does not have any problems due to the nature of the autonomous legislation of ordinance. In addition,the comparison to similar precedents reveals that the legislation of ordinance in the level of Samcheock city local government will not cause anyproblems. The legislation of theordinance initiated by Samcheock City Council is more meaningful considering the purpose of Isabu’s promotional project encompassing ‘the East Sea’ that Samcheok city has proceeded for several years and this year’s historical significance as 1,500 years of the subjugation of Usan country (Ulreungdo& Dokdo) by Isabu and the proper timing. Finally, if necessary for the temporal condition, even with the legislation of ‘rules’ by the head of local government, Day of Isabu or the festival of Isabu can be considered.
