우리나라도 인구의 고령화와 복지 패러다임의 변화와 더불어 장애인단체 등을 중심으로
성년후견제도 도입을 위한 활동, 장애인권리협약 체결 등의 영향으로 2011년 2월 민법개정안
이 국회를 통과하고, 2013년 7월 1일 새로운 성년후견제도가 본격 시행되었다.
도입 과정에서 민법개정안과 특별법 제정안, 일원론과 다원론 등 많은 논의와 쟁점들이 존
재했지만 우리 법률체계와 현실 등을 고려하여 민법개정을 통한 다원론 형태의 성년후견제
도를 도입하게 되었다. 그러나 장애인 권리협약 등 현대적인 상황을 반영하여 부분적으로 일
원론적인 형태가 일부 도입되었다.
우리나라 성년후견제도는 피후견인의 행위능력의 범위와 후견의 업무범위와 대리권 등에
따라 성년후견, 한정후견, 특정후견 으로 나누고 장래 치매 등 정신적 제약 등을 대비해 미
리 후견계약을 체결해두는 후견계약 등으로 나누어진다.
성년후견제도 이용현황은 꾸준히 증가하고 있으나 아직까지 홍보부족과 일반국민들의 인
식 부족, 제도적 미비 등으로 성년후견유형이 다수를 차지하고 있고, 한정후견이나 특정후견,
후견계약유형의 이용이 널리 확산되지 못하고 있다.
따라서 우리나라 성년후견제도의 활성화를 위해서는 여러 정책적 과제들이 있지만 우선
제도이용 절차나 피후견인을 지원할 수 있는 구체적인 조항과 법률이 정비되어야 한다. 또한
피후견인의 인권을 침해할 수 있는 선거권의 제한이나 인신결정에 대한 동의조항 등 피후견
인의 인권을 제한 할 수 있는 조항 등이 정비되어야 하며, 300여개 법률 등에서 존재하는 피
성년후견인이나 피한정후견인에 대한 결격 조항 등에 대한 정비가 필요하다.

영어 초록

With the changes of welfare paradigm and aging population, the conclusion of the
Convention on the Rights of Persons with Disabilities and activities for introduction of
adult guardianship system mainly promoted by organizations for the disabled helped a
revision on the civil law to be passed in February 2011, and a new adult guardianship
system was put into effect on July 1, 2013.
In the process of the introduction, there were a lot of discussions and issues relating to
the revision to the civil law, special law enactment, monism and pluralism, but the adult
guardian system of a form of pluralism through the revision of the civil law was
introduced in consideration of the legal system and reality of Korea. However, a form of
monism was partially introduced by reflecting the contemporary situations such as the
Convention on the Rights of Persons with Disabilities.
Korean adult guardianship system is divided into adult guardianship, limited
guardianship and specific guardianship depending on the range of a ward's behavioral
ability and business scope, and the right of representation of the guardianship, and
guardianship agreement signed in preparation for the future mental constraints such as
dementia.
The use of adult guardianship system has continuously been on the rise. However, due
to the lack of publicity, public awareness and institutional devices, only the adult
guardianship is rampant, and the use of limited guardianship, specific guardianship and
guardianship agreement is not widely spread.
Therefore, in order to activate the adult guardianship system in Korea, a lot of political
agendas can be considered. First of all, however, it is required to maintain specific
provisions and regulations to support wards or institutional procedures for using the
system. In addition, there is a need to maintain provisions that can restrict the human
rights of wards such as the consent to personal decisions or the limitation of voting rights
that can violate the human rights of wards, along with the maintenance of provisions
regarding the disqualification of adult ward or limited ward which are present in more
than 300 laws.
