본 논문은 금융감독 통합법이 우리나라의 올바른 금융감독기능 개선을 위해 필요하다는 시각에따라, 금융감독 관련 사안을 총괄적으로 규정하는 금융감독기본법을 제시하였다. 금융감독기본법
은 다음과 같은 내용으로 구성되었다. 첫째, 금융감독체계 개편의 기본 방향으로서 금융산업정책
과 금융감독정책 기능의 제도적 분리, 금융건전성감독원과 금융시장감독원으로 구성된 쌍봉형 금
융감독체계, 금융감독기구의 민간 공적기구화, 그리고 금융감독유관기구간 협력체계를 위한 금융
안정협의회의 제도화를 제시하였다. 둘째, 현행 「금융위원회의 설치 등에 관한 법률」에 없는
금융감독기구와 금융회사간의 관계에 대한 일반적 규정을 포함하여, 이 규정이 각 업법에서 개별
적으로 규정되는 양자간의 관계를 설정하는 가이드라인으로서 기능하도록 하였다. 구체적으로 금
융회사가 피규제업무를 영위하기 위해 감독기구의 허가를 얻는 과정과 금융회사의 피규제업무 영
위과정에 대한 감독기구의 감독에 관한 내용과 기본 원칙을 규정하였다. 셋째, 금융감독기본법은
분쟁조정, 제재 및 위법행위 신고자 보호에 대해서도 새로운 대안을 제시하였다. 금융소비자분쟁
조정센터를 현행 금융분쟁조정위원회를 대체하도록 하여 분쟁조정기구가 금융소비자 보호기구로
서 독립성과 전문성을 확보하도록 하였다. 또한 제재 절차의 공정성과 투명성 확보를 위하여 제재
위원회 설치 및 제재 방안의 개선 등을 제시하였다. 끝으로 금융감독기본법은 관련 당사자의 신고
유인을 장려하여 금융규제의 유효성을 제고하는 방안도 제안하였다.
영어 초록
The current paper proposes a model of an integrated legislation for Korea thatseeks to incorporate financial supervisory structure and regulatory activities. The
purpose of the proposal is to improve the overall effectiveness of Korea's financial
supervisory function by integrating, wherever appropriate, supervisory rules and
regulations scattered in various parts of the current regulatory system. The proposal
makes the following three legislative recommendations in an integrated and coherent
manner. First, financial supervisory function should be separated from functions
dealing with financial services industries, with a 'twin peaks' system in place for
financial supervisory structure. Legislation of a coordination mechanism called
'Financial Stability Council' is also recommended. Second, legislation of relationships
between financial supervisory authorities and financial firms is newly proposed. This
legislation aims to fill in and serve as a guideline to cope with any lack of such
relationships in the associated regulatory system in Korea. For example, it deals with
the process by which financial firms obtain permissions to perform regulated
functions from the regulator and the rules and principles governing such permissions
and other supervisory activities by the regulator. Third, the proposal also
recommends alternative and comprehensive legislation in each of the following:
dispute settlements, penalties for financial service providers and whistleblower
protection. Specifically, it recommends the establishment of 'Financial Consumer
Dispute Settlement Center' which is to replace the existing committee in the FSS and
of a new independent committee to deal with fair and transparent penalties against
financial service providers. It also recommends ways to enhance the protection of
whistleblowers who report actual or suspected regulatory violation to any financial
regulator.
