• Separation of powers
o Constitution- Article 1  establishes Congress of Senate and House of Representatives
o Constitution – Article 2  gives the President the executive power – to execute and enforce the laws passed by Congress
o Constitution- Article 3  gives the judicial power of the US to the Supreme Courts- determines the types of cases the federal courts may decide
• Checks & balances (= allows the branches to check each other’s power/ put limits)
o Article 1 gives the president the power to veto legislation passed by Congress, but allows Congress to override such a veto by a 2/3rds vote of each House
o Article 1 & 2 provide that the president, the vice president and other fed officials may be impeached and removed from office by a 2/3 vote of the Senate.
o Article 2 states that treaties made by president and removed by a 2/3 vote of Senate.
o Article 3 gives Congress some control over the Supreme Court’s appellate jurisdiction.
o All powers not given to the federal government (that isn’t denied to the states) is to be reserved for STATES & PEOPLE.
o Federal Supremacy- federal statutes preempt/trump inconsistent state laws.
o Constitution also puts limits on the states’ lawmaking powers.
