Currently, the most significant legislation related to employment of persons with disabilities is the Americans with Disabilities Act (ADA), passed in 1990. Among the five Titles of the ADA, Title I includes bans against discrimination in hiring, firing, compensation, advancement, and training, and also requires employers to make “reasonable accommodations” for those with disabilities unless this would cause “undue hardship” (DiNitto, 2003). In short, the purpose of Title I of the ADA is to ensure equal access to employment opportunities for qualified individuals with a disability (Rubin & Roessler, 2001).
However, there have been controversial debates on the effectiveness of the ADA. On the one hand, some researchers such as Karger (Karger, Midgley, & Brown, 2002) insisted that the ADA has not worked in increasing the rate of employment for persons with disabilities. On the other hand, Rubin (Rubin & Roessler, 2001) maintained that, due to the overall conservative posture taken by the courts in ADA cases, the achievement of the ADA has been limited.
