Background
India had not admit about patent for making method, but had admit product patent in pharmaceutical and agricultural chemical products according to India's the patents Act(1972). So If they had made same product in different method, it would not have violated India's patent law. So India had exported lots of generic drug based on their excellent chemical process technique and cheap labor at that time. However, India was faced with a big problem by the effectivation of AGREEMENT ON TRADE-RELATED ASPECTS OF INTELLECTUAL PROPERTY RIGHT (TRIPS Agreement) in 1995. Because TRIPS Agreement include a article(20.1) which is stated about patent for making method.

배경
인도는 1972년 재정된 인도특허법(Pantents Act, 1972년 4월 20일 발효)에 의하여 물질특허는 인정하나 제법특허는 인정하지 않았다. 그 때문에 제조공정만 달리하면 동일한 물질을 복제해도 인도특허법 하에서는 불법이 아니었다. 따라서 당시 인도는 우수한 화학가공처리기술과 저렴한 인건비를 바탕으로 다량의 일반의약품(generic)을 인도 국내시장 및 해외시장으로 수출하고 있었다.
1995년 TRIPS 협정발효로 인도는 어려움에 직면하게 되었다. TRIPS 27조 1항에 명시적으로 물질 및 제법을 모두 특허의 대상으로 포함하고 있었다.
